Dual Agency

Dual agency occurs when a single real estate agent or brokerage represents both the buyer and the seller in the same transaction.

In a dual agency arrangement, the agent cannot fully advocate for either side because their loyalty is divided. They are limited to facilitating the transaction rather than negotiating aggressively on behalf of one party.

Dual agency is legal in some states but restricted or prohibited in others. In Louisiana, dual agency is permitted but must be disclosed in writing and agreed to by both parties before the transaction proceeds.
